End User License Agreement

1. General Provisions
1.1. This license agreement (hereinafter referred to as the Agreement) is an agreement between the end user (hereinafter referred to as the User) and RST Cloud Pty Ltd (hereinafter referred to as RST Cloud) about the software of RST Cloud products (hereinafter referred to as the Software).
1.2. The use of the Software is permitted only under the terms of the Agreement. By using the Software, the User agrees to comply with the terms of the Agreement in full. If the User does not accept the terms of the Agreement in full, the User is not entitled to use the Software in any way, including storing the Software on storage devices.
2. License
2.1 License Grant
RST Cloud hereby grants the user a non-exclusive and non-transferable right to use the Software for a specified period, after which the User must stop using it. For Software for which RST Cloud provides updates and changes, the existence of a License implies the right to receive and use updates and changes during the License Term.
2.2 License Term
The right to use the Software by the User is limited for a certain period. The term is set individually in each Order to the Partnership Agreement.
2.3 Scope
User may use the Software subject to the following license restrictions; however, any use of the Software in violation of any of these restrictions or any other terms of this Agreement violates this Agreement and is not licensed. The User is obliged to use the Software under the terms of use. The User has no right and agrees not to allow others to modify, adapt, translate, sublicense, rent or lease all or any part of the Software. The User cannot and agrees not to allow others to create derivative works based on all or any part of the Software.
3. Terms of use
3.1 The User uses the Software to download information from the RST Cloud resources available on the Internet using the access key(s).
3.2 If the number of requests to RST Cloud resources is exceeded the limits established by the RST Cloud rules, the User's requests may be rejected at the initiative of the RST Cloud.
3.3 The resumption of the possibility of making requests is carried out after the expiration of the temporary block.
3.4 Limitations on the number of User requests per day / month / year are governed by the type of purchased license.
3.5 The software can also be used for integration with other software and hardware-software solutions, as well as cloud services used by the User subject to the provisions of section 2.3 of this agreement.
4. Confidentiality
4.1 The software is not intended to convey confidential information.
4.2 The software allows the User to send data to RST Cloud specialists that the User has identified as suspicious and requiring additional analysis or attention from RST Cloud.
4.3 The Software allows the User to send data to RST Cloud specialists, which the User has identified as false positives and which, following the opinion of the User, should not be present in the results of the Software.
4.4 The user must initiate the fact of sending data himself and is responsible for the composition of the transmitted information.
4.5 In the event of an error in the transfer of certain information, the User can send an electronic appeal to RST Cloud with a request to delete them.
4.6 The user undertakes not to transfer the access key(s) to third parties and to ensure that only authorized persons can access them.
4.7 In case of compromise or suspicion of possible unauthorised access to the keys of third parties, the User must contact RST Cloud to obtain a new key and deactivate the current one.
5. Resource availability
RST Cloud, during the License Term, will use all commercially reasonable efforts to:
a) Providing the User with access to the resources of the RST Cloud company necessary for the operation of the Software within the limitations of a particular license, within 24 hours a day, 365 days a year
b) Ensuring the required level of access security
c) Provide daily updates to the database of indicators of compromise
d) Notify in advance about the planned unavailability of resources in connection with their maintenance by publishing this information using the company's public Internet resources.
6. End User Warranties
6.1 As an end user, User represent that you are aware that the software is provided "as is" without any express or implied warranties of any kind to the extent permitted by applicable law.
6.2 Neither the supplier, nor its partners acting as licensors or affiliates, nor the copyright holders make any representations or provide any express or implied obligations or warranties, in particular, sales warranties or warranties of fitness for a particular use, as well as warranties that it the software does not infringe any patents, copyrights, trademark rights or other rights of third parties. the supplier and any others do not warrant that the software functions will meet your requirements or that the software will function without glitches or errors. all responsibility and risk in choosing the software to achieve the desired results, and in installing, using and obtaining the results that you will achieve with the software, rests with you.
6.3 RST Cloud shall not be held liable in any way for damages (including, without limitation, damages in the form of lost profits, business interruption, loss of business information and other specific damages) arising from the use or inability to use the Software, including if RST Cloud has been alerted to the possibility of such damage.
